realMLS has an updated MLS policy to provide sellers and their listing agents more choices when marketing a property, while also supporting fair housing by providing buyers and their agents with equal access to important MLS property information.
As of October 1, the new Seller Controlled Marketing Disclosure form replaces both the Coming Soon Listing Addendum and the Seller’s Waiver of Entry Into the NEFMLS Addendum. The updated form has been distributed to all form vendors, and the previous forms should no longer be used.
[IMPORTANT: If a listing is entered into the MLS within 3 days (previously 24 hours) of the effective date, the Seller Controlled Marketing Disclosure is not needed.]
The Broker Distribution tab in Flexmls has also been updated to provide more choices during listing input.
[IMPORTANT: No changes to the Broker Distribution tab are necessary if a listing should be distributed to all available options.]

Summary of Expanding Seller Controlled Marketing
Extended Time to Enter Listings: Listings can now be submitted into the MLS within 3 days of the effective listing date or final signatures (previously 24 hours).
Listing Distribution Options: Under the Broker Distribution tab in Listing Add/Edit, fields that were always part of the listing but previously hidden are now visible. These include IDX/VOW and syndication options (e.g., Realtor.com, Listhub). These settings are still controlled by the “Seller Directs Listing to be Excluded from Internet” option, which remains the default. No action is required for standard internet distribution.
New Disclosure Form – Seller Controlled Marketing Disclosure: This single form replaces both the Coming Soon Addendum and the Seller Waiver of Entry and offers two options:
Option 1: Coming Soon – timeframe extended from 21 days to 30 days
Option 2: Seller’s Waiver of MLS Benefits – listing may be permanently withheld from MLS benefits (must be submitted to listingwaiver@realmls.com) with the ability to set a future entry date.
